Welcome to InmateCanteen.com. TW Vending Inc., d/b/a TurnKey Corrections (“TurnKey”) and/or its affiliates (collectively, "Inmate Canteen") provide website features and other products and services to you when you visit or shop at InmateCanteen.com, use Inmate Canteen products or services, use Inmate Canteen applications for mobile, or use software provided by Inmate Canteen in connection with any of the foregoing (collectively, "Inmate Canteen Services").
By using Inmate Canteen, you agree to and accept these Conditions of Use. Please read them carefully.
We offer a wide range of Inmate Canteen Services, and sometimes additional terms may apply. Specifically, your use of Inmate Canteen Services is made possible by and strictly subject to that certain Jail Services Agreement by and between this Facility and TurnKey, and by accepting these Conditions of Use, you are ageing that all terms and conditions contained in that Jail Services Agreement shall apply to you and to your use hereunder. Further, when you use Inmate Canteen Services, you also will be subject to the guidelines, terms and agreements applicable to each specific Inmate Canteen Service, or the service terms of third party vendors (collectively, the "Service Terms"). If these Conditions of Use are inconsistent with any Service Terms, and so long as you have been made aware of those specific Service Terms, those Service Terms will control.

Please review our Privacy Notice, which also governs your use of Inmate Canteen Services, to understand our privacy practices.
ELECTRONIC COMMUNICATIONS
When you use any Inmate Canteen Service, or send e-mails to us, you are communicating with us electronically. In return, you consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site or through the other Inmate Canteen Services. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
PAYMENT CARDS
Payment instructions for Visa, MasterCard, and Discover may be entered on InmateCanteen.com. Such payment instructions are subject to any Service Terms as well as the terms of service of the card issuer. InmateCanteen.com cannot accept payment instructions for any other cards or other methods of payment at this time.
TIME FRAME FOR SUBMISSION OF PAYMENT INSTRUCTIONS
Payment instructions on InmateCanteen.com are processed immediately, and will appear on statement as InmateCanteen.com. Funds deposited at a facility for use by a third party/inmate are available immediately, and product purchased for a third party/inmate will generally be delivered within seven (7) days of the purchase. Any error in fulfillment, packaging, or delivery of product purchased for a third party/inmate must be resolved directly with TurnKey.
FEES
Inmate Canteen charges a flat processing fee for each payment instruction processed by InmateCanteen.com. Inmate Canteen reserves the right to change the amount of the processing fee at any time, without notice to users. The processing fee will be displayed prior to processing the payment instructions, and the user may choose not to process the payment instructions if the fee is unsatisfactory. Processing of any payment will signify acceptance of such fee.
TRADEMARKS
Graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Inmate Canteen Service are trademarks or trade dress of Inmate Canteen. Inmate Canteen's trademarks and trade dress may not be used in connection with any product or service that is not Inmate Canteen's, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits Inmate Canteen. All other trademarks not owned by Inmate Canteen that appear in any Inmate Canteen Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by Inmate Canteen, but whose rights in such trademarks must not be infringed.
INTELLECTUAL PROPERTY
One or more protected pieces of intellectual property apply to the Inmate Canteen Services and to the features and services accessible via the Inmate Canteen Services. Portions of the Inmate Canteen Services operate under intellectual property licenses. All use of the Inmate Canteen Services is subject to the protections of the applicable intellectual property laws and regulations.
ACCESS
Subject to your compliance with these Conditions of Use and your payment of any applicable fees, Inmate Canteen or its content providers grant you a limited, non-exclusive, non-transferable, non-sublicensable access and make personal and non-commercial use of the Inmate Canteen Services. This access does not include any resale or commercial use of any Inmate Canteen Service, or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of any Inmate Canteen Service or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. All rights not expressly granted to you in these Conditions of Use or any Service Terms are reserved and retained by Inmate Canteen or its licensors, suppliers, publishers, rightsholders, or other content providers. No Inmate Canteen Service, nor any part of any Inmate Canteen Service, may be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of Inmate Canteen. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of TurnKey or Inmate Canteen. You may not use any meta tags or any other "hidden text" utilizing TurnKey’s or Inmate Canteen's name or trademarks. You may not misuse the Inmate Canteen Services. You may use the Inmate Canteen Services only as permitted hereunder and as by law. The access granted by Inmate Canteen terminate if you do not comply with these Conditions of Use or any Service Terms.
YOUR ACCOUNT
If you use any Inmate Canteen Service, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your account, and you agree to accept responsibility for all activities that occur under your account or password. You are responsible for all efforts to deposit money into your account and for all withdrawals therefrom. You will be provided information as to the deposits and withdrawals into and from your account, and should immediately report any suspicious activity to the facility administrator. If you are under 18, you may use the Inmate Canteen Services only with involvement of a parent or guardian. Inmate Canteen reserves the right to refuse service, terminate accounts, remove or edit content, or cancel instructions/orders, at its sole and absolute discretion. If you use any Inmate Canteen Service, you agree that Inmate Canteen reserves the right to use all such use for its marketing, advertising and product development purposes, at its sole discretion.
SYSTEM ABUSE
Access to Inmate Canteen is a privilege and not a right. Any individual who abuses the privilege may lose access to the Inmate Canteen Services.
Such abuse can be defined as, but is not limited to, illegal activity, improper or malicious use of equipment, or fraud. The account holder is fully responsible for any funds deposited which are derived from fraudulent activity. Any inmate who benefits from the deposit and use of fraudulently obtained funds shall be unable to use any service offered by Inmate Canteen Services at any correctional facility using Inmate Canteen until such time as Inmate Canteen and the correctional facility are fully reimbursed. Accounts may be frozen and amounts contained therein may be confiscated as a means toward remedying any wrongdoing, and inmates may be terminated and/or blocked from Inmate Canteen Services at any time if the system or the privilege of access to the system is abused. If your account has been frozen for any reason, no refunds will be issued.
Your use of Inmate Canteen Services is your agreement that all funds you receive into or otherwise hold in your account are subject to confiscation by TurnKey for the purposes of reimbursing TurnKey for any deposits into your account which are claimed to have been deposited wrongly or fraudulently.
RETURNS AND REFUNDS
Inmate Canteen does not accept returns of physical products that you purchase for a third party/inmate. Returns may, at Inmate Canteen's discretion, be accepted for physically defective products you purchase, reasonable wear and tear excepted, and if the physically defective product is timely returned to Inmate Canteen. No refunds will be given for such defective product, and replacement of the defective item will be the only remedy provided. No refunds will be given for payment instructions processed.
PRODUCT DESCRIPTIONS
Inmate Canteen attempts to be as accurate as possible. However, Inmate Canteen does not warrant that product descriptions or other content of any Inmate Canteen Service is accurate, complete, reliable, current, or error-free.
INMATE CANTEEN SOFTWARE
In addition to these Conditions of Use, the terms found here apply to any software (including any updates or upgrades to the software and any related documentation) that we make available to you from time to time for your use in connection with Inmate Canteen Services (the "Inmate Canteen Software"). It is not part of the Inmate Canteen Services to safeguard against any interruption- and latency-free end-to-end connection between different users of the software. You acknowledge that the Inmate Canteen Services may be unavailable or include latency from time to time due to technical difficulties or due to causes beyond the reasonable control of Inmate Canteen. Additionally, you hereby acknowledge that the end-to-end connection between different users of the software is dependent on your internet connection to the data center as well as your use of hardware and software (e.g. kiosk, PC, operating system) in compliance with system requirements for the software, all of which shall not be included in the Inmate Canteen Services provided by Inmate Canteen and shall be your responsibility.
DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
THE INMATE CANTEEN SERVICES AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) AND OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE INMATE CANTEEN SERVICES ARE PROVIDED BY INMATE CANTEEN ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW. UNLESS OTHERWISE REQUIRED BY APPLICABLE LAW, INMATE CANTEEN MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE INMATE CANTEEN SERVICES, OR THE INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE INMATE CANTEEN SERVICES, YOU EXPRESSLY AGREE THAT YOUR USE OF THE INMATE CANTEEN SERVICES IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, INMATE CANTEEN DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. INMATE CANTEEN DOES NOT WARRANT THAT THE INMATE CANTEEN SERVICES, INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE INMATE CANTEEN SERVICES, INMATE CANTEEN'S SERVERS OR ELECTRONIC COMMUNICATIONS SENT FROM INMATE CANTEEN, ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. INMATE CANTEEN WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF ANY INMATE CANTEEN SERVICE, OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS (INCLUDING SOFTWARE) OR OTHER SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH ANY INMATE CANTEEN SERVICE, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES.
APPLICABLE LAW
By using any Inmate Canteen Service, you agree that the Federal Arbitration Act, applicable federal law, and the laws of the State of Wisconsin, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Inmate Canteen.
SITE POLICIES, MODIFICATION, AND SEVERABILITY
Please review our other policies, such as our pricing policy, posted on this site. These policies also govern your use of Inmate Canteen Services. We reserve the right to make changes to our site, policies, Service Terms, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

Our customer service hours of operation are Monday thru Friday, 8:30 AM to 4:30 PM, Central Time. We will reply to customer service requests made by email within one (1) business day.

HOW TO SERVE A SUBPOENA
If you have a subpoena to serve on Inmate Canteen, please note that Inmate Canteen does not accept service via e-mail or fax and will not respond to the subpoena. All subpoenas must be properly served on InmateCanteen.com, preferably by mailing the subpoena to our main office. Please find below the address for our main office:

Please note also that providing detailed and accurate information at the outset will facilitate efficient processing of your request. That information will include, for example, e-mail and/or credit card number used for purchases, IP address and complete time stamp.
ADDITIONAL INMATE CANTEEN SOFTWARE TERMS:
- Use of the Inmate Canteen Software. You may use Inmate Canteen Software solely for purposes of enabling you to use and enjoy the Inmate Canteen Services as provided by Inmate Canteen, and as permitted by the Conditions of Use, these Software Terms and any applicable Service Terms. You may not incorporate any portion of the Inmate Canteen Software into your own programs or compile any portion of it in combination with your own programs, transfer it for use with another service, or sell, rent, lease, lend, loan, distribute or sub-license the Inmate Canteen Software or otherwise assign any rights to the Inmate Canteen Software in whole or in part. You may not use the Inmate Canteen Software for any illegal purpose. We may cease providing any Inmate Canteen Software and we may terminate your right to use any Inmate Canteen Software at any time. Your rights to use the Inmate Canteen Software will automatically terminate without notice from us if you fail to comply with any of these Software Terms, the Conditions of Use or any other Service Terms. Additional third party terms contained within or distributed with certain Inmate Canteen Software that are specifically identified in related documentation may apply to that Inmate Canteen Software (or software incorporated with the Inmate Canteen Software), and will govern the use of such software in the event of a conflict with these Conditions of Use. All software used in any Inmate Canteen Service is the property of Inmate Canteen or its software suppliers and protected by United States and international copyright laws.
- Use of Third Party Services. When you use the Inmate Canteen Software, you may also be using the services of one or more third parties, such as a wireless carrier or a mobile platform provider. Your use of these third party services may be subject to the separate policies, terms of use, and fees of these third parties.
- No Reverse Engineering. You may not, and you will not encourage, assist or authorize any other person to copy, modify, reverse engineer, decompile or disassemble, or otherwise tamper with, the Inmate Canteen Software, whether in whole or in part, or create any derivative works from or of the Inmate Canteen Software.
- Updates. In order to keep the Inmate Canteen Software up-to-date, we may offer automatic or manual updates at any time and without notice to you.
- Export Regulations; Government End Users. You must comply with all export and re-export restrictions and regulations of the Department of Commerce and other United States agencies and authorities that may apply to the Inmate Canteen Software. If you are a U.S. Government end user, we are licensing the Inmate Canteen Software to you as a "Commercial Item" as that term is defined in the U.S. Code of Federal Regulations (see 48 C.F.R. § 2.101), and the rights we grant you to the Inmate Canteen Software are the same as the rights we grant to all others under these Conditions of Use.
